Janam Technologies (“Janam”) warrants its products to be free from defects in materials and workmanship at the time of shipment. This limited warranty does not cover any Janam product which is (i) damaged by accident or negligence, including, without limitation, failure to follow the proper maintenance, service, and cleaning schedule; (ii) improperly used or installed; or (iii) damaged due to (a) operation under conditions beyond the specified operating parameters, or (b) excessive voltage or current supplied to or drawn from the product interface connections, or (c) static electricity or electro-static discharge, or (d) repair or service of the product by anyone other than Janam or its authorized service representatives, or (e) modification or alteration by the purchaser or other party. This limited warranty shall extend for a period of twelve (12) months from the time of shipment to a first end user, or for such other greater or lesser duration published by Janam for the product at the time of purchase (“Warranty Period”).
All Janam HT1, XG4, XM75+, XR2, XT3, and BTS-01 products come with a standard warranty of two (2) years. All other devices come with a standard warranty of one (1) year. Any defective product must be returned (at purchaser’s expense) during the Warranty Period to Janam’s factory or authorized service center for inspection. No product will be accepted by Janam without a Return Materials Authorization, which may be obtained by contacting Janam as provided at its website. In the event that the product is returned to Janam or its authorized service center within the Warranty Period and Janam determines to its satisfaction that the product is defective due to defects in materials or workmanship, Janam, at its sole option, will either repair or replace the product without charge, except for return shipping to Janam. Excluded items including batteries, handstraps, tethers, cables, accessories and peripherals are not covered by this limited warranty except for initial failure occurring within 90 days from date of purchase by the first end user, in which failure is not caused by abuse or misapplication.
EXCEPT AS MAY BE OTHERWISE PROVIDED BY APPLICABLE LAW, THE FOREGOING LIMITED WARRANTY IS IN LIEU OF ALL OTHER COVENANTS OR WARRANTIES, EITHER EXPRESSED OR IMPLIED, ORAL OR WRITTEN, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. JANAM’S RESPONSIBILITY AND PURCHASER’S EXCLUSIVE REMEDY UNDER THIS LIMITED WARRANTY IS LIMITED TO THE REPAIR OR REPLACEMENT (AT JANAM'S SOLE OPTION) OF THE DEFECTIVE PRODUCT. IN NO EVENT SHALL JANAM BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, AND, IN NO EVENT, SHALL ANY LIABILITY OF JANAM ARISING IN CONNECTION WITH ANY PRODUCT SOLD HEREUNDER (WHETHER SUCH LIABILITY ARISES FROM A CLAIM BASED ON CONTRACT, WARRANTY, TORT, OR OTHERWISE) EXCEED THE ACTUAL AMOUNT PAID TO JANAM FOR THE PRODUCT. THESE LIMITATIONS ON LIABILITY SHALL REMAIN IN FULL FORCE AND EFFECT EVEN WHEN JANAM MAY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH INJURIES, LOSSES, OR DAMAGES. SOME STATES, PROVINCES, OR COUNTRIES DO NOT ALLOW THE EXCLUSION OR LIMITATIONS OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
All provisions of this Limited Warranty are separate and severable, which means that if any provision is held invalid and unenforceable, such determination shall not affect the validity of enforceability of the other provisions hereof. Use of any peripherals not manufactured/sold or certified by Janam for use with a Janam product voids this limited warranty. This includes but is not limited to: cables, power supplies, cradles, and docking stations. Janam Technologies extends this limited warranty only to the first end-users of the products. This limited warranty is nontransferable except where otherwise set forth by written agreement between Janam and members of its distribution channel.

Janam offers several JanamCare® Service Plans for continued coverage on Janam handhelds after the initial limited warranty expires. Certain plans must be purchased within 30-days of handheld purchase. Please contact Janam Sales or your Authorized Reseller for more information.
